Trademark registration is a type of intellectual property protection, through which a proprietor can protect his/her brand name. The trademark may be a word or visual symbol used by a business to distinguish it goods or services of the proprietor from other similar goods or services. To register a trademark, a trademark application must be filed by the applicant with the relevant Trade Mark Registrar in the prescribed format. Once a trademark application is filed, the Trade Marks Registrar would process the application and issue an Examination Report. Among the outcomes, the Trademark Examination Report could allow for the trademark application to be advertised before registration or raise an objection for registration.
In cases the Trade Mark Registrar approves an application for advertisement in the Trademark Journal before registration; any person in the Public has the opportunity to oppose the registration of the mark within 4 months from the date of advertisement. After submission of Rule 45 it is the duty of the attorney of the opponent to submit the Rule 46 with in the 2 months from the date of submission of Rule 45. in case the opponent is not capable to submit the evidence in front of the registrar within the prescribed time duration then the trademark registrar has the power to abandon the oppose notice. The registrar shall decide after hearing the parties, if so required and considering the evidence, as to whether and subject to what consideration or limitations, if any the registration is to be permitted.
